We are a 99% Self-Funded Nonprofit Organization
USPA’s nonprofit arm, Kingsman, derives all of its funding from a profit share with USPA Nationwide Security. This unique funding model allows Kingsman to operate independently, taking on missing persons cases from six continents. However, the number of cases we can handle is directly tied to the success of our philanthropic efforts and the self-funding generated through our partnership with USPA Nationwide Security. As such, while we strive to assist as many families as possible, our capacity is limited to the resources available through these efforts.

No, Kingsman team members do not take salaries from the donations or funds received. All money we raise and receive goes directly toward our operations, ensuring that every dollar is used to support our mission of locating and recovering missing girls.

Kingsman uses its funds to support various investigative activities, including but not limited to travel expenses for field operations, hiring skilled subcontractors, utilizing advanced digital investigation tools, and spreading awareness through flyer distribution and online promotion.
How does Kingsman conduct its investigations while respecting constitutional boundaries?
At Kingsman, we conduct our investigations with careful consideration to avoid crossing the threshold of acting under the color of law enforcement. This is crucial to ensure that constitutional guarantees, such as the Fourth Amendment right against unreasonable searches and seizures, do not attach to our actions.

The Fourth Amendment, as stated in U.S. Const. amend. IV, guarantees citizens’ rights to be free from unreasonable searches and seizures. However, this protection only extends to actions by government officials or those acting at their direction. The Supreme Court has consistently held this view, as seen in cases like Skinner v. Ry. Labor Execs.’ Ass’n, 489 U.S. 602, 613-14 (1989); Coolidge v. New Hampshire, 403 U.S. 443, 487 (1971); and Burdeau v. McDowell, 256 U.S. 465, 475 (1921). Therefore, the Fourth Amendment does not apply to searches or seizures conducted by private parties on their own initiative, unless those parties act as agents or instruments of the Government (Skinner, 489 U.S. at 614).
We ensure that our operations remain independent and are not conducted at the direction of any government agency, thereby maintaining the integrity of our investigative efforts without infringing on constitutional rights.
How does Kingsman ensure its investigations are independent and not acting as agents of the government?
At Kingsman, we maintain strict independence in our investigative activities to ensure that we do not operate as agents of the government. Even when government officials are aware of or passively allow a warrantless search, courts have been reluctant to consider private actors as government agents unless those actors are motivated solely or primarily by the intent to aid law enforcement officers, and the government did not request the challenged search (United States v. Smith, 383 F.3d 700, 705 (8th Cir. 2004)).
In our work, we are careful to conduct investigations based on our own initiatives and objectives, not at the direction or for the benefit of law enforcement agencies. This approach allows us to assist in the recovery of missing individuals while respecting legal boundaries and ensuring that constitutional protections remain intact.
How does Kingsman operate when working alongside law enforcement?
When Kingsman works alongside law enforcement, which often occurs in our operations, we maintain the same high standards of integrity and professionalism as our sworn law enforcement partners. In these situations, we ensure that all actions are conducted in strict adherence to constitutional guarantees.
For example, if we are questioning a suspect while under a government contract or in collaboration with any government agency, we will read the Miranda rights and obtain a signed waiver of these rights before proceeding with any questioning. This practice ensures that we uphold the constitutional protections of individuals, just as our law enforcement partners do, while effectively supporting the shared goal of recovering missing individuals and ensuring public safety.
